1. Who we are
Apex Path (“Apex Path,” “we,” “us,” or “our”) is a private residential real estate investment company that purchases and resells property for cash. Our mailing address is 1309 Coffeen Ave, STE 10290, Sheridan, WY 82801, United States.
Under U.S. state privacy laws, Apex Path is the business that determines the purposes and means of processing the personal information described in this policy.
2. Scope of this policy
This policy covers personal information we collect through the website at apexpath.net, through our contact form, and in the course of evaluating, negotiating, and closing property transactions with sellers, buyers, agents, and other parties.
Apex Path is a United States company and buys and sells property located in the United States. This website is intended for U.S. residents. We do not direct our services to people outside the United States, and we do not track or monitor them. If you visit this site from another country, your information will be sent to, stored in, and processed in the United States under U.S. law.
This policy does not cover the independent privacy practices of the licensed title companies, escrow agents, attorneys, inspectors, surveyors, or lenders involved in a transaction. Those parties handle your information under their own policies and their own legal obligations, and you should review theirs directly.
3. Information we collect
3.1 Information you give us
When you submit our contact form, or when you speak with us by phone or email, we may collect:
- Identifiers — your name, phone number, and email address.
- Property information — the address of the property, its condition, occupancy, and your desired timeline.
- Role — whether you identify yourself as a seller, a buyer, or an agent or other party.
- Free-text details — anything you choose to type into the message field, which may include information about liens, probate, tenancy, or your personal circumstances.
- Consent record — the fact that you checked the consent box, and the date and time you did so. We keep this as proof of the permission you gave us to contact you.
Please do not send us Social Security numbers, bank account or card numbers, government ID numbers, health information, or other sensitive data through the website form. Where that information is genuinely required for a transaction, it is collected by the title company through its own secure channels, not by us.
3.2 Information we collect automatically
Our web host and content delivery providers record standard technical information when you visit the site, including your IP address, browser type and version, device type, operating system, the pages you request, the date and time of the request, and the referring page. This is ordinary server-log data used for security, abuse prevention, and to keep the site working.
3.3 Information from other sources
To evaluate a property and make you an offer, we consult sources that are public or commercially available: county recorder and assessor records, tax records, deed and lien filings, multiple listing service data, and comparable-sales data. This information relates primarily to the property, though public records may also identify owners by name.
4. How we use your information
We use personal information only for the purposes below:
- To respond to your enquiry and contact you by phone and email, as you authorized.
- To evaluate a property, prepare a written cash offer, and negotiate terms.
- To open escrow and complete a transaction through a licensed title company.
- To maintain records of offers, agreements, closings, and consents.
- To notify buyers on our list about properties matching what they told us they want.
- To operate, secure, and improve the website and prevent fraud, spam, and abuse.
- To comply with legal, tax, anti-money-laundering, and record-keeping obligations, and to establish, exercise, or defend legal claims.
We do not use your information for unrelated purposes, and we do not use it to build advertising profiles about you.
5. SMS text messaging program
Apex Path operates an SMS program for people who ask us about buying or selling a property. This section describes it in full.
Mobile information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of information described in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Mobile opt-in data and consent are never sold, rented, or released under any circumstances, except to the messaging service providers who deliver the messages on our behalf, and then only to send the messages you asked for.
5.1 How you opt in
You opt in by entering your mobile number on the contact form at apexpath.net and checking the consent box before submitting it. The box is not pre-ticked, it is not bundled with anything else, and the form cannot be submitted without it. We keep a record of the consent text you agreed to and the date and time you agreed to it. We never add a number to the program from a purchased list, a third party, or a public record.
5.2 What we send
Messages relate to the enquiry you submitted: a reply to your request, a cash offer or a question about the property, scheduling for an inspection or survey, and updates about a closing in progress. Message frequency varies and depends on your conversation with us. We do not send recurring marketing blasts.
5.3 Cost
Message and data rates may apply. Apex Path does not charge for the messages, but your mobile carrier’s standard rates apply to messages you send and receive.
5.4 Opting out and getting help
- Reply STOP to any message to be removed from the program. We send one confirmation message and then stop.
- Reply HELP for help, or write to us at the address in section 20.
- You may also opt out by any other reasonable means — tell us on a call, in an email, or by post, and we will stop.
- We keep a minimal suppression record so your opt-out is honored going forward. Withdrawing consent does not affect anything we lawfully did before you withdrew it.
5.5 Carriers and delivery
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier’s network and is not guaranteed. Supported carriers may change without notice.
5.6 Calls, and email
- Calls. By providing your number and checking the consent box, you also consent to receive calls from Apex Path about your enquiry and the property, including calls placed with an automatic telephone dialing system or a prerecorded or artificial voice, at the number you provided.
- Consent is not a condition. Agreeing to receive calls or texts is not a condition of any purchase, sale, or offer from Apex Path, and declining costs you nothing.
- Do Not Call. We honor the National Do Not Call Registry and state do-not-call lists. Where you have given us express written consent through our form, we may contact you about your enquiry notwithstanding a registry listing, and you can revoke that consent at any time.
- Email. Any marketing email we send identifies us, gives our postal address, and includes a working unsubscribe link, as required by the CAN-SPAM Act. We honor unsubscribe requests promptly.
- Transaction messages. If you are under contract with us, we may still need to reach you about the closing itself. Those are service messages, not marketing.
We do not send anyone to your door unannounced, and we do not buy lead lists to cold-call.
6. Who we share information with
We share personal information only in the following circumstances:
- Title companies, escrow and settlement agents — to run title, clear liens, hold funds, prepare settlement statements, and record the deed.
- Transaction professionals — inspectors, surveyors, appraisers, contractors, attorneys, and notaries engaged for a specific transaction.
- Counterparties — where we resell a property, the information necessary to complete that transaction passes to the buyer and their professionals.
- Service providers — web hosting, form processing, email, and document storage vendors who act on our instructions under contract, and who are not permitted to use your information for their own purposes.
- Professional advisers — accountants, auditors, and lawyers, under duties of confidentiality.
- Legal and safety — where required by law, subpoena, court order, or regulator, or where necessary to investigate fraud or protect the rights and safety of any person.
- Business transfer — if Apex Path is involved in a merger, acquisition, financing, or sale of assets, information may transfer as part of that transaction, subject to this policy.
Text messaging originator opt-in data and consent are excluded from every category above and are not shared with any third party for any purpose other than delivering the messages you asked for. See section 5.
7. We do not sell or share your information
Apex Path does not sell personal information, and has not sold personal information in the preceding twelve months. We do not share personal information for cross-context behavioral advertising, and we do not use or disclose sensitive personal information for purposes beyond those permitted under California law. We have never had actual knowledge of selling or sharing the personal information of anyone under 16 years of age.
Disclosures to title companies, service providers, and transaction professionals as described above are made for business purposes and are not sales.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
8. Cookies and tracking
This website does not set advertising or analytics cookies, and we do not run third-party advertising pixels or trackers on it. Web fonts are loaded from Google Fonts, which means your browser makes a request to Google’s servers that includes your IP address. Standard server logs are kept as described in section 3.2.
Because we do not sell or share personal information and do not run targeted advertising, there is nothing to opt out of. We nevertheless honor Global Privacy Control and other browser-based opt-out preference signals as valid opt-out requests wherever applicable law requires it, and we treat Do Not Track signals the same way. If we introduce analytics or advertising cookies in future, we will update this policy and, where required, obtain your consent before any non-essential cookie is set.
9. How long we keep information
We keep personal information only as long as we have a reason to, then delete or anonymize it:
- Enquiries that do not lead to an offer — up to 24 months, then deleted.
- Offers made but not accepted — up to 3 years, for business records and to answer any later question about the offer.
- Closed transactions — at least 7 years, and longer where property, tax, or limitation-period rules require it.
- Consent and opt-out records — at least 5 years, because we must be able to prove that consent was given and that opt-outs were honored.
- Buyer-list contact details — until you unsubscribe, plus a minimal suppression record afterwards.
- Server logs — typically 30 to 90 days.
10. How we protect information
We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of the information we hold. These include encryption of the website in transit (HTTPS), access controls that limit personal information to the people who need it, contractual confidentiality obligations on our vendors, and a practice of routing sensitive financial and identity information through the licensed title company rather than through us.
No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. Please do not email us sensitive financial details, and stay alert to wire fraud: we will never send you wiring instructions, and you should confirm any wiring instruction by calling the title company on a number you have independently verified.
11. Your privacy rights
Depending on the state you live in, you may have some or all of the rights below. We honor these rights for anyone who asks, in any state, except where a law requires us to keep something.
- Know and access — to be told what personal information we hold about you, where we got it, why we process it, and who we disclose it to, and to receive a copy.
- Correct — to have inaccurate information about you corrected.
- Delete — to have your personal information deleted, subject to legal retention obligations.
- Portability — to receive your information in a portable, machine-readable format.
- Opt out — of any sale or sharing of personal information, of targeted advertising, and of profiling with legal or similarly significant effects. We do none of these.
- Limit sensitive information — to restrict our use of sensitive personal information.
- Withdraw consent — at any time, including consent to be called, texted, or emailed.
- Appeal — to appeal our refusal of a request, where your state gives you that right.
- Non-discrimination — we will never deny you an offer, change your price, or give you worse terms because you exercised a privacy right.
12. How to exercise your rights
Send us a request through the contact form, or write to us at Apex Path, 1309 Coffeen Ave, STE 10290, Sheridan, WY 82801, USA. Tell us which right you want to exercise and give us enough detail to find your records.
- Verification. Before we act on a request to access or delete, we verify that the request really comes from you, usually by matching details you gave us when you first made contact. We may ask for one additional piece of information; we will not ask for more than we need, and we will not use it for anything else.
- Timing. We acknowledge requests within 10 business days and respond substantively within 45 calendar days. If we need more time, we will tell you why and take no more than a further 45 days.
- Cost. Requests are free, unless they are manifestly unfounded or excessive, in which case we will tell you before doing anything.
- Authorized agents. You may use an authorized agent. We will ask for written permission signed by you and will still verify your identity directly.
- Appeals. If we deny your request and your state law provides an appeal, you may appeal by replying to our decision. We will respond within 45 days and tell you how to contact your state Attorney General if you remain dissatisfied.
13. California-specific disclosures
If you are a California resident, the CCPA as amended by the CPRA gives you the rights listed in section 11. In the preceding twelve months we have collected the categories of personal information described in section 3 — identifiers, commercial information relating to a property transaction, internet or network activity in the form of server logs, coarse geolocation implied by an IP address, and the contents of any message you choose to send us. We collected it from you, from your device, and from public records, for the purposes set out in section 4, and we disclosed it for business purposes to the categories of recipients set out in section 6.
We have not sold or shared personal information, and we do not process sensitive personal information for purposes that would trigger a right to limit. California residents may also request, once a year and free of charge, information about disclosures of personal information to third parties for their direct marketing purposes under California’s “Shine the Light” law (Civil Code § 1798.83); we make no such disclosures.
You may designate an authorized agent to make requests on your behalf, and you will not be discriminated against for exercising any of these rights.
14. Other U.S. state rights
Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Minnesota, Maryland, Tennessee, Indiana, Kentucky, Rhode Island, and other states with comprehensive privacy laws in force have rights to access, correct, delete, and obtain a copy of their personal data, and to opt out of targeted advertising, the sale of personal data, and certain profiling. Because we do none of those three things, there is nothing to opt out of — but the access, correction, deletion, portability, and appeal rights all apply, and are exercised as described in section 12.
Nevada residents may submit a verified request that we not sell their covered information; we do not sell it in any event.
15. Children’s privacy
Our website and services are directed to adults. We do not knowingly collect personal information from anyone under 16, and we do not knowingly sell or share the personal information of minors. If we learn that we have collected information from a child under 16 without the consent required by the Children’s Online Privacy Protection Act or applicable state law, we will delete it. A parent or guardian who believes a child has given us information should contact us and we will remove it.
16. Automated decision-making
We do not make decisions about you by automated means alone, and we do not profile you in a way that produces legal or similarly significant effects. Our offers are prepared by people, using comparable sales, the condition of the property, and the cost of the work it needs.
17. Third-party links
Our site may link to third-party websites, including those of title companies and public records offices. We do not control those sites and are not responsible for their content or their privacy practices. Read their policies before giving them information.
18. Data breach notification
If a security incident compromises your personal information, we will notify you and the relevant state authorities as required by the breach-notification law of your state — without unreasonable delay — and we will tell you what happened and what you can do about it.
19. Changes to this policy
We may update this policy as our practices or the law change. The “last updated” date at the top of this page always reflects the current version. If a change is material, we will make it prominent on the site, and where the law requires consent for the change we will ask for it before it takes effect. Continuing to use the site after an update means you accept the revised policy.
